TERMS AND CONDITIONS
These Terms and Conditions govern your access to and use of The Dealer's Circle, a yearly membership program operated by The Time-Art. By purchasing a membership or accessing any content within The Dealer's Circle, you agree to be bound by these terms in full.
Please read these terms carefully before completing your purchase.
1. ABOUT THE DEALER'S CIRCLE
The Dealer's Circle is an annual membership program offered by The Time-Art, a professional art business education platform. The membership provides access to a 12-month curriculum, live and recorded classes, interactive tools, downloadable resources, and a private member community. All content is developed and delivered by The Time-Art.
2. MEMBERSHIP AND ACCESS
2.1 Eligibility
Membership is open to individuals who operate or intend to operate in the art market in any capacity, including artists, brokers, agents, and gallerists. By enrolling, you confirm that the information you have provided is accurate and complete.
2.2 Annual Membership
The Dealer's Circle operates on a yearly subscription basis. Your membership begins on the date of purchase and remains active for 12 consecutive months. At the end of your membership term, your access will expire unless renewed.
2.3 Personal Use Only
Your membership is for your individual use only. You may not share your login credentials, transfer your membership, or allow any other person to access The Dealer's Circle using your account.
2.4 Access to Content
Upon active membership, you will have access to all content available during your membership term, including curriculum articles, recorded classes, interactive activities, and downloadable resources. The Time-Art reserves the right to add, modify, or remove content at any time in order to maintain quality and relevance.
3. PAYMENT AND PRICING
3.1 Membership Fee
The annual membership fee is $799 USD per year, billed at the time of purchase. All fees are stated in US dollars and are subject to applicable taxes where required by law.
3.2 Payment Processing
Payments are processed securely through Wix. The Time-Art does not store your payment information. By completing your purchase, you agree to Wix's terms of service and privacy policy.
3.3 Price Changes
The Time-Art reserves the right to change the membership price at any time. Price changes will apply to renewals and new memberships only. Your current membership term will be honored at the price you paid.
3.4 Taxes
You are responsible for any taxes, duties, or levies applicable to your membership in your jurisdiction.
4. CANCELLATION AND REFUND POLICY
4.1 Annual Commitment
The Dealer's Circle is an annual program. By purchasing a membership, you are committing to a 12-month term.
4.2 No Refunds
No refunds will be issued for any reason, including partial use of the membership, dissatisfaction with content, or failure to engage with the program.
4.3 Cancellation of Renewal
If you do not wish to renew your membership, you must cancel your renewal before your renewal date. Cancellation of renewal does not entitle you to a refund of any amount already paid. Your access will remain active until the end of your current membership term.
5. INTELLECTUAL PROPERTY
5.1 Ownership of Content
All content within The Dealer's Circle, including but not limited to curriculum articles, class recordings, methodology frameworks, interactive tools, downloadable templates, visual assets, and written materials, is the exclusive intellectual property of The Time-Art. All rights are reserved.
5.2 License to Members
Your membership grants you a limited, personal, non-exclusive, non-transferable license to access and use The Dealer's Circle content for your own professional development. This license does not permit reproduction, distribution, resale, sublicensing, or public display of any content.
5.3 Prohibited Uses
You may not copy, screenshot, record, transcribe, republish, share, sell, or otherwise distribute any content from The Dealer's Circle without the prior written consent of The Time-Art. This includes sharing content in any format with individuals who are not active members.
5.4 Proprietary Frameworks
The Time-Art Method, the dealer tier system, the collector archetype framework, and all associated terminology, metrics, and naming conventions, including Total Placements, Depth Score, and Global Impact Number, are proprietary to The Time-Art. You may apply these frameworks in your own business practice but may not reproduce, teach, or commercialize them without written authorization.
5.5 Member-Generated Content
Any written responses, submissions, or materials you create within The Dealer's Circle remain your own intellectual property. By submitting content to the community or any interactive tool, you grant The Time-Art a non-exclusive license to use that content for educational and illustrative purposes within the membership, with your identity protected.
6. COMMUNITY STANDARDS
6.1 Telegram Community
Access to The Dealer's Circle private Telegram community is included in your membership. By participating in the community, you agree to conduct yourself with professionalism, respect, and integrity at all times.
6.2 Prohibited Conduct
The following behaviors will result in immediate removal from the community and, at the discretion of The Time-Art, termination of your membership without refund:
Harassment, intimidation, or disrespectful conduct toward other members or The Time-Art team. Sharing, reproducing, or distributing any membership content outside the community. Solicitation of other members for commercial purposes without prior approval. Posting misleading, defamatory, or harmful content. Impersonating another member or The Time-Art.
6.3 Moderation
The Time-Art reserves the right to moderate, remove, or restrict any content or member at its sole discretion.
7. DISCLAIMER OF WARRANTIES
The Dealer's Circle is provided for educational and professional development purposes. The Time-Art makes no guarantee of specific business outcomes, revenue results, or career advancement as a result of your membership. The curriculum is based on The Time-Art's professional experience and methodology, and results will vary depending on individual circumstances, effort, and market conditions.
Content is provided on an as-is basis. The Time-Art does not warrant that the platform will be uninterrupted, error-free, or free from technical issues.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, The Time-Art shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your membership, including loss of income, loss of data, or loss of business opportunity. The Time-Art's total liability to you under any circumstance shall not exceed the amount you paid for your current membership term.
9. PRIVACY
Your personal data is collected and processed in accordance with The Time-Art Privacy Policy, which is incorporated into these Terms and Conditions by reference. By purchasing a membership, you consent to the collection and use of your data as described in the Privacy Policy.
10. MODIFICATIONS TO THESE TERMS
The Time-Art reserves the right to update these Terms and Conditions at any time. Material changes will be communicated to active members via email with at least 14 days notice. Your continued use of The Dealer's Circle after the effective date of any changes constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you may allow your membership to expire without renewal.
